RikRak Terms of Service

1. Introduction and Agreement
Welcome to RikRak, which includes our website (available at rikrak.ai) and our AI-powered tutoring platform operated by Yardstick Inc., a Washington State corporation.
These Terms of Service ("Terms") are a legally binding agreement between you and Yardstick Inc. ("RikRak," "we," "us," or "our"). By visiting our website, creating an account, accessing, or using RikRak, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy.
If you do not agree to these Terms, do not use the platform.
2. Scope of Terms
These Terms apply to all visitors to the RikRak website ("Visitors") and all registered users of the RikRak tutoring platform ("Platform Users"). Certain provisions apply only to Platform Users, as indicated below. Unless a provision specifies that it applies only to Platform Users, it applies to both Visitors and Platform Users.
The following Sections apply only to Platform Users: Sections 3 (Eligibility and Age Requirements), 4 (Accounts), 6 (Subscription Plans and Pricing), 7 (Acceptable Use), 8 (User Content), and 13 (Indemnification). All other Sections apply to both Visitors and Platform Users.
3. Eligibility and Age Requirements
This Section applies only to Platform Users.
RikRak is currently available only to users in the United States. The minimum age to use RikRak in any capacity is 8 years old. We have designed the platform with student safety in mind and comply with the Children’s Online Privacy Protection Act (COPPA). Our age-based requirements are as follows:
Children under 13. Children under 13 may not create their own accounts. A parent or legal guardian must create an account and add a child profile for the child. The parent or guardian must provide verifiable parental consent before the child can use the platform. Our current consent process involves sending a consent confirmation email to the parent or guardian, who must take an additional verification step (such as responding to the email or completing a confirmation form) before the child’s profile is activated. We may update our consent methods over time to use additional or alternative verification measures as permitted under COPPA.
Teens ages 13–17. Teens between 13 and 17 may sign up for their own accounts. However, a parent or guardian email address is required at signup so we can notify the parent of the teen’s registration. If a parent or guardian objects to the teen’s use of the platform after receiving this notification, the parent may request that the teen’s account be closed by contacting us at legal@yardstick.team. Upon receiving such a request, we will close the teen’s account and delete the associated data in accordance with our Privacy Policy.
Adults 18 and older. Adults may create and use accounts under these standard Terms.
We use a date-of-birth age gate during signup, along with session-level flags to prevent circumvention of our age verification system. Attempting to bypass or misrepresent age during signup is a violation of these Terms and may result in immediate account termination.
4. Accounts
This Section applies only to Platform Users.
4.1 Account Creation
To use RikRak, you must create an account with a valid email address and accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4.2 Parent and Family Accounts
Parents and guardians can create child profiles under their account. Parents may set PINs for individual child profiles to manage access. The parent or guardian who creates the account is the account holder and is responsible for all activity across all child profiles on that account.
4.3 Account Security
You agree to notify us immediately at legal@yardstick.team if you believe your account has been compromised. We are not liable for any loss resulting from unauthorized use of your account.
5. The Service
RikRak is an AI-powered tutoring platform designed for middle school and high school students, with plans to expand to additional age groups and educational levels over time. The platform provides AI-generated tutoring sessions to support students’ learning.
RikRak is not a substitute for professional instruction. The tutoring content provided by our AI is for educational support purposes only. AI-generated content may occasionally contain inaccuracies or errors. Students, parents, and guardians should not rely on RikRak as a sole source of academic instruction or guidance.
5.1 AI-Generated Content and Automated Processes
RikRak uses artificial intelligence to generate tutoring content, adapt learning materials, and provide educational feedback. These processes are automated and are not reviewed by human instructors in real time. The AI may adapt content based on a student’s interactions, assess understanding of topics, and make recommendations about areas for further study. Users should understand that these are algorithmically generated outputs and not the product of human judgment or professional evaluation.
5.2 AI Training Practices
We do not use identifiable student data to train or fine-tune AI models. Student data is transmitted to our AI providers solely to generate tutoring responses in real time, and our providers are contractually prohibited from using that data for model training. As described in Section 8.3 (Anonymized Data), we may use anonymized and aggregated session data — stripped of all personally identifiable information — to improve our AI tutoring technology. For children under 13, we apply additional safeguards as described in our Privacy Policy and in compliance with COPPA.
6. Subscription Plans and Pricing
This Section applies only to Platform Users.
6.1 Free Tier
Every new account includes a free tier of tutoring sessions as described on our pricing page. These sessions are shared across all child profiles on the account. Once the free sessions are used, you will need to subscribe to a paid plan to continue using the platform.
6.2 Paid Subscription
Paid subscriptions are available at the pricing set forth on our pricing page at rikrak.ai/pricing, which may be updated from time to time. All prices are in US dollars and may be subject to applicable taxes. Your subscription will be billed at the rate displayed on the pricing page at the time of your subscription or renewal, unless we notify you of a pricing change in accordance with Section 6.6.
6.3 Billing
Subscriptions are billed on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method each billing cycle. Your use of Stripe’s payment services is subject to Stripe’s Terms of Service.
6.4 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the paid features through the end of your current billing period. No further charges will be made after cancellation takes effect.
6.5 Refunds
We generally do not offer refunds or credits for partial months or unused sessions. However, we may issue refunds at our sole discretion under exceptional circumstances, such as extended service outages or billing errors. To request a refund, contact us at legal@yardstick.team.
6.6 Pricing Changes
We reserve the right to change our pricing at any time. If we change pricing for your current subscription, we will provide you with at least thirty (30) days’ advance notice before the new pricing takes effect. Continued use of the platform after a price change constitutes acceptance of the new pricing.
7. Acceptable Use
This Section applies only to Platform Users.
You agree to use RikRak only for its intended educational purposes. The following activities are prohibited:

Academic dishonesty. Using the platform to cheat on tests, exams, homework assignments, or any other assessed work, or to facilitate cheating by others.

Account sharing. Sharing your account credentials or providing access to individuals outside your immediate family or household.

Automated access. Using bots, scrapers, crawlers, or any other automated means to access, collect data from, or interact with the platform.

Age verification circumvention. Attempting to bypass, manipulate, or misrepresent information in our age verification system.

Reverse engineering. Attempting to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying models of any part of the platform, including our AI systems.

Illegal use. Using the platform for any purpose that violates applicable local, state, or federal law.
Violation of these rules may result in suspension or termination of your account at our sole discretion.
8. User Content
8.1 Content You Upload
RikRak may allow you to upload materials such as class notes, syllabi, assignments, and other educational content ("User Content"). You retain full ownership of any User Content you upload.
By uploading User Content, you grant RikRak a non-exclusive, royalty-free, limited license to use, reproduce, and process that content solely for the purpose of providing the tutoring service to you. This license terminates when you delete the content or your account, whichever comes first. We do not claim ownership of your User Content, and we will not use it for purposes beyond delivering the service to you.
8.2 Your Responsibilities
You are responsible for ensuring you have the right to upload any content you provide. You agree not to upload content that infringes on the intellectual property rights of others, contains malware, or is otherwise unlawful.
8.3 Anonymized Data
We may use anonymized and aggregated session data — meaning data that has been stripped of all personally identifiable information and cannot be linked back to any individual user — to improve and develop our AI tutoring technology. This anonymized data does not include your User Content in identifiable form.
9. Intellectual Property
9.1 RikRak’s Property
The RikRak platform, including its software, design, branding, logos, text, graphics, and all other non-user content, is the property of Yardstick Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the platform without our prior written consent.
9.2 AI-Generated Content
Content generated by our AI during tutoring sessions is provided for your personal educational use. This content is generated algorithmically and may vary in accuracy. We make no guarantee that AI-generated content is error-free, complete, or suitable for any specific academic purpose.
9.3 DMCA and Copyright Complaints
If you believe that content on RikRak infringes your copyright, please send a notice to our designated copyright agent at copyright@yardstick.team with the following information:

A description of the copyrighted work you believe has been infringed.

A description of where the allegedly infringing material is located on the platform.

Your contact information (name, address, phone number, and email).
-
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.

A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Your physical or electronic signature.
10. Third-Party Services
RikRak relies on third-party services to deliver parts of the platform:

Payment processing is handled by Stripe, and your use of payment features is subject to Stripe’s Terms of Service.

AI features are powered in part by third-party AI providers, as listed in our Privacy Policy. When you use the platform, certain session data (such as your tutoring queries and uploaded content) may be transmitted to these providers solely for the purpose of generating tutoring responses. For children under 13, this data sharing is conducted in compliance with COPPA and is limited to what is necessary to provide the tutoring service. These providers act as service providers and are contractually prohibited from using this data for their own purposes.
The quality, availability, and performance of RikRak may depend in part on these third-party services. We are not responsible for outages, errors, or limitations caused by third-party providers.
11. Children’s Privacy and COPPA Compliance
RikRak is committed to protecting the privacy of children who use our platform. This Section summarizes our COPPA-related practices; please also review our Privacy Policy for complete details about our data collection, use, and disclosure practices as they relate to children under 13.
11.1 Data We Collect from Children
We collect only the information necessary to provide the tutoring service, as described in detail in our Privacy Policy. This may include a display name or username, age or date of birth (for age-gating purposes), tutoring session data (questions asked, topics explored, and AI-generated responses), and uploaded educational materials. We do not collect more personal information from children than is reasonably necessary to provide the service.
11.2 How We Use Children’s Data
Children’s personal information is used solely to provide and improve the tutoring service. Session data may be shared with our third-party AI providers only as necessary to generate tutoring responses in real time, and these providers are contractually prohibited from using this data for model training or any other purpose. We do not use children’s personal information for advertising, profiling, or any purpose unrelated to the educational service.
11.3 Parental Rights
Parents and legal guardians of children under 13 have the following rights under COPPA:

Review. You may review the personal information we have collected from your child by contacting us at privacy@yardstick.team.

Deletion. You may request that we delete your child’s personal information. Upon receiving a verified request, we will delete the information and direct any service providers to do the same.

Refuse further collection. You may refuse to permit further collection of your child’s personal information. If you do so, your child’s access to the platform may be limited or terminated, as certain data collection is necessary to provide the tutoring service.
To exercise any of these rights, contact us at privacy@yardstick.team. We will verify your identity as the child’s parent or guardian before processing your request.
11.4 Data Retention for Children
We retain children’s personal information only as long as reasonably necessary to fulfill the purpose for which it was collected. When a child’s profile is deleted, we delete the associated personal information in accordance with our Privacy Policy. Parents may request immediate deletion at any time as described above.
12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the platform will be uninterrupted, error-free, or secure. We do not provide any uptime guarantees or service-level agreements. AI-generated tutoring content is for educational support only and should not be relied upon as a substitute for professional academic instruction, advice, or evaluation.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Yardstick Inc., its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages resulting from your use of or inability to use the platform.
Our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the platform is limited to the amount you have actually paid to RikRak in the 12 months immediately preceding the event giving rise to the claim. If you are on the free tier and have not paid anything, our total liability is limited to $50.
14. Indemnification
This Section applies only to Platform Users.
If you are the account holder (the parent, guardian, or adult who created the account), you agree to indemnify, defend, and hold harmless Yardstick Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your or your children’s use of the platform in violation of these Terms, (b) User Content you upload that infringes the rights of a third party, or (c) any misrepresentation you make under these Terms.
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-law principles.
15.2 Jurisdiction and Class Action Waiver
You and Yardstick Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the platform shall be resolved exclusively in the state and federal courts located in King County, Washington. You agree to waive your right to participate in a class action, class-wide arbitration, or any other representative proceeding. All disputes must be brought in an individual capacity only.
If the class action waiver in this Section is found to be unenforceable by a court of competent jurisdiction, then any putative class action or representative proceeding shall nonetheless be conducted exclusively in the state and federal courts located in King County, Washington, and the remaining provisions of this Section shall remain in full force and effect.
For any dispute, you consent to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington.
16. Account Suspension and Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. Upon termination, your right to use the platform ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 6.5, 8.3, 9, 10, 12, 13, 14, 15, and 18) will continue to apply.
You may also delete your account at any time through your account settings or by contacting us at legal@yardstick.team.
16.1 Effect of Account Deletion
If you delete your account while an active paid subscription is in effect, you will retain access to the platform through the end of your current billing period unless you specifically request immediate deletion. If you request immediate deletion, your access will end immediately and no refund will be issued for the remaining billing period.
16.2 Data Export and Deletion
Before deleting your account, you may export your data (including session history and uploaded content) through your account settings. Following account deletion, we will retain your data for the period described in our Privacy Policy (currently two years) unless you request immediate deletion of your data at the time of account closure. To request immediate data deletion, contact us at privacy@yardstick.team.
17. Data Breach Notification
In the event of a security breach that results in unauthorized access to, or disclosure of, personal information, we will notify affected users in accordance with applicable state and federal law. Where required by law, we will provide notification as promptly as reasonably possible. If the breach involves children’s personal information, we will also notify the relevant parent or guardian account holder. We will take commercially reasonable steps to mitigate the effects of any breach and prevent future occurrences.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised Terms on the platform and update the “Last Updated” date at the top of this page. Your continued use of the platform after changes are posted constitutes your acceptance of the updated Terms. If we make material changes, we will make reasonable efforts to notify you (for example, by email or an in-app notice).
19. General Provisions
Severability. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Yardstick Inc. regarding your use of RikRak. They supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
No Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Force Majeure. Yardstick Inc. will not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemic or epidemic, internet or telecommunications failures, power outages, fire, flood, labor disputes, or disruption of third-party services on which the platform depends.
Electronic Communications. By using the platform, you consent to receiving communications from us electronically, including by email and in-app notifications. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
California Residents. If you are a California resident, you may have additional rights under California Civil Code Section 1789.3. You may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210, in order to resolve a complaint regarding the service or to receive further information regarding use of the service.
20. Accessibility
Yardstick Inc. is committed to making RikRak accessible to all users, including individuals with disabilities. We strive to conform to Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. If you experience any difficulty accessing or using the platform, or if you have suggestions for improving accessibility, please contact us at legal@yardstick.team. We take accessibility feedback seriously and will make reasonable efforts to address reported issues.
